Medical Malpractice – Deformed Eyelid

$800,000.00 Settlement

Our client’s newborn baby was delivered six weeks prematurely. Nurses in the neonatal unit placed the child on oxygen. However, while in the neonatal unit, the nurses allowed the strap holding the oxygen in place to slip over the child’s face and over her eyes. Despite repeated pleas from our client, the simple act of moving the strap was not done. The strap left the child unable to completely open her right eye. Our nursing expert effectively determined prior to trial that the hospital nurses failed to properly care for the child and caused this completely unnecessary injury.

Automobile Accident – Crushed right hand

Our client’s 3 year old son was sitting in his father’s driveway playing with a friend. Unfortunately, a visitor to the house pulled out of the driveway and ran over the boy, crushing his right hand. A 37 year old postman was driving in his mail truck when he was struck in the rear by a commercial truck. The operator of the truck then inexplicably attempted to flee the scene. Upon his apprehension, it was determined that he was operating the truck with a suspended license. Our 20 year client was driving her car through an intersection when she was broadsided by a tow truck who had run a red light.  The severe impact forced our client to strike her head on the driver's side window rendering her unconscious and causing a subarachnoid hemmrage, also know as a bleed on the brain.  To this day she still has no recollection of the accdent.  Subsequently, she was left with mild residual congnitive impairments for which she will have to deal with into the forseeable future.  The insurance copmany for the tow truck attempted to show that her injuries had resolved completely and she returned to her pre-accident status.  However, prior to trial  we were able to resolve the case and enable our client to have the resources for her future medical needs.

Our 51 year old client was operating his car eastbound through an intersection when a disoriented elderly woman was traveling southbound and ran the red light at the intersection and struck our client at a high rate of speed resulting in him sustaining severe injuries to his neck. After treating conservatively thereafter for several months, he unfortunately underwent neck surgery to alleviate the continuing pain. The surgery involved the placement of plates and screws to stabilize his spine. Our client a 73 year old retiree, was walking home on a sidewalk from the grocery store when a teenage driver, who had only been a licensed driver approximately 4 months, was operating his father’s car when he sped around a curb at a high rate of speed, lost control and jumped onto the sidewalk and struck our client resulting in her injuries. She underwent surgery to set her broken bones. Upon being approached by the insurance company, she hired our firm to ensure that her rights would be protected. Shortly after filing a lawsuit in the matter we were able to force the insurance carrier for both the teenage driver’s father as well as our client to pay the maximum amount of their policy limits.

Automobile Accident – Thumb Surgery

Our 29 year old client was driving his car westbound down a commercial street, when the operator of the car directly to his right decided he need to turn into a plaza on the south side of the road. He then attempted a left hand turn from the right hand lane causing our client to strike his vehicle. The impact caused our client’s hand to jam the steering wheel which resulted in him fracturing his right thumb. Ultimately, due to the pain he endured, he underwent surgery to correct the fracture including the placement of a plate and screws to stabilize the joint. The surgery left our client without full range of motion of his right thumb from which he will never recover.

Automobile Accident – Fractured Skull

Our client’s 6 year old son was playing in the street in front of his house with his older brothers and sisters when a careless motorist who was looking down at the time drifted to her right and struck the boy and then unwittingly dragged him for another 100 feet before coming to a stop. The boy suffered a fractured skull which required him to be airlifted to the hospital as well as medical treatment for months thereafter. Upon retaining our law firm and the subsequent filing of a lawsuit, the insurance carrier for the negligent driver finally meet their responsibilities to the boy and his parents.

Automobile Accident – Facial Burns

Our 46 year old client brought his vehicle into the local auto mechanic for service. The mechanic told our client that the repairs would take some time and that he could borrow one of his shop vehicles. After our client proceeded onto the highway, the vehicle spontaneously combusted resulting in him sustaining 2nd and 3rd degree burns on his face and arms. The resulting painful skin grafts left our client with scarring.
